IMPLEMENTASI PENGENDALIAN KERUSAKAN LINGKUNGAN BERDASARKAN PERDA PROVINSI JAWA TENGAH NOMOR 4 TAHUN 2023 TENTANG PERLINDUNGAN DAN PENGELOLAAN LINGKUNGAN HIDUP DI BROWN CANYON, KOTA SEMARANG

Abstract

The implementation of environmental damage control has been regulated in Regional Regulation Number 4 of 2023 concerning Environmental Protection and Management. This study aims to see the Implementation of the Central Java Provincial Environmental and Forestry Service in implementing Central Java Provincial Regional Regulation Number 4 of 2023 and to analyze the driving and inhibiting factors of the Central Java Provincial Environmental and Forestry Service in implementing environmental damage control due to mining activities in Brown Canyon, Semarang City. This study uses a qualitative approach through observation and interviews with related sources. The results of the study show that the implementation of environmental damage control has been running but not fully, this can be seen in ensuring the fulfillment and protection of environmental rights as part of Human Rights. Driving factors include the commitment of the Central Java Provincial Environmental and Forestry Service to carry out supervision and assistance to both the community and related parties regarding the importance of environmental sustainability. The inhibiting factors felt by the implementer are communication between the government and the community that has not been running and the weak laws in force so that sanctions for environmental violators are not firm. This study recommends that Mining Business Permits be terminated or revoked for business actors who damage the environment and that sanctions be strengthened for violators of environmental management and administration policies.
